Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Dialogue Consulting Pty Ltd ("Bellhop", "we", "us"), the company that provides the Bellhop platform. They apply whenever you access or use Bellhop, whether through a free trial, a paid subscription, or an early-access arrangement. If you use Bellhop on behalf of an organization, you confirm you have authority to bind that organization, and "you" means that organization. If you do not agree to these Terms, do not use Bellhop.
The service
Bellhop is a website personalization platform. You install a lightweight script on your website, define the content zones you want to personalize, and provide a knowledge base drawn from your own content. Bellhop then rewrites those zones in real time at the edge to match each visitor's search intent and the company associated with their visit, grounded in the material you supply. We may add, change, or remove features over time as the product evolves.
Accounts & eligibility
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account.
- You must be at least 18 and able to form a binding contract. Bellhop is a business tool and is not intended for personal or consumer use.
- You must have the right to install the Bellhop script on, and personalize content for, the website(s) you connect.
Plans, trials & billing
- Paid plans are billed in advance on a recurring basis through our payment processor. Fees are exclusive of taxes unless stated otherwise.
- Free trials and early-access arrangements may carry their own limits and end dates; usage during a private beta is also governed by any separate early-access agreement you have with us.
- Unless required by law, fees already paid are non-refundable. You can cancel at any time, effective at the end of the current billing period.
- We may change pricing with reasonable notice; changes take effect at your next renewal.
Acceptable use
You agree not to, and not to allow anyone else to:
- Use Bellhop to publish content that is unlawful, deceptive, infringing, or that you do not have the right to display.
- Personalize content in a way that misleads visitors or violates advertising, consumer-protection, or data-protection law.
- Attempt to identify individual people from the company-level signals Bellhop provides, or otherwise misuse identification data.
- Reverse engineer, resell, or circumvent the security or usage limits of the service.
- Interfere with the integrity or performance of Bellhop or its infrastructure, or use it to transmit malware.
We may suspend access where use threatens the security, legality, or stability of the service.
Your content & knowledge base
You retain all rights to the content, copy, and knowledge base you provide ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process, and use Your Content solely to operate and provide the service to you — including indexing it for retrieval and using it to ground the copy Bellhop generates. You are responsible for ensuring Your Content is accurate and that you hold the rights needed for us to process it. Because Bellhop's generated copy is grounded in Your Content, you are responsible for reviewing personalized output that is published on your site.
Data processing & privacy
When Bellhop processes personal data about your website's visitors, it does so on your behalf as your processor, under your instructions. You are the controller of that data and are responsible for having a lawful basis and any notices or consents your jurisdiction requires before personalization runs. Our handling of data is described in our Privacy policy; where a separate data-processing agreement applies, it forms part of these Terms.
Intellectual property
Bellhop, including its software, runtime, models, design, and documentation, is owned by Dialogue Consulting Pty Ltd and protected by intellectual-property laws. We grant you a limited, non-transferable, non-exclusive right to use the service during your subscription. We may use aggregated, de-identified data about service usage to operate and improve Bellhop. Any feedback you share may be used without restriction.
Third-party services
Bellhop relies on, and can integrate with, third-party services — including our cloud infrastructure provider, IP-intelligence providers, a payment processor, and optional integrations such as a CRM you connect. Your use of those services is subject to their own terms. We are not responsible for third-party services, and connecting an integration authorizes the exchange of data you direct between Bellhop and that service.
Availability & changes
We work to keep Bellhop available and performant, but we do not guarantee uninterrupted service. We may perform maintenance, modify features, or impose reasonable usage limits. Bellhop is designed to fail safe: if personalization cannot be served, your site falls back to its standard, un-personalized content.
Disclaimers
To the maximum extent permitted by law, Bellhop is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that personalization will increase conversions or that generated copy will be error-free. Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded, including under the Australian Consumer Law.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the twelve months before the event giving rise to the claim. These limits do not apply to liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold Bellhop harmless from claims, losses, and expenses arising out of Your Content, your websites, your use of the service in breach of these Terms, or your failure to obtain any consents or lawful basis required to personalize content for your visitors.
Term & termination
These Terms apply for as long as you use Bellhop. You may stop using the service and cancel at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the service unlawfully. On termination, your right to use Bellhop ends; we will make Your Content available for a reasonable period for export where practicable, after which it may be deleted. Sections that by their nature should survive termination — including intellectual property, disclaimers, liability limits, and indemnification — will survive.
Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state, without affecting any non-excludable rights you have under the law of your own jurisdiction.
Changes to these terms
We may update these Terms as the product and our legal obligations evolve. When we make material changes, we will update the date above and, where appropriate, notify account holders. Continuing to use Bellhop after changes take effect means you accept the updated Terms.
